Acceptance of terms

By accessing or using AnnuityMatchPro (the "Site"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy and Disclosures. If you do not agree to these Terms, do not use the Site.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL ANNUITYMATCHPRO, ITS OPERATORS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST SAVINGS, LOSS OF DATA, OR ECONOMIC LOSS) ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR ANY CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ANNUITYMATCHPRO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SITE IS TO STOP USING IT.

Some jurisdictions do not allow the exclusion or limitation of certain damages. To the extent any exclusion is unenforceable, ANNUITYMATCHPRO's total cumulative liability is limited to the greater of (a) the amount you paid to AnnuityMatchPro in the twelve months preceding the claim or (b) one hundred dollars ($100).

Indemnification

You agree to indemnify and hold harmless AnnuityMatchPro and its operators, affiliates, and licensors from any claim, demand, or damage (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your violation of any rights of another party.

Governing law and venue

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-laws principles. Any dispute arising from these Terms or your use of the Site will be resolved in the state or federal courts located in Arizona, and you consent to the personal jurisdiction of those courts.

Dispute resolution

Before pursuing any formal legal action, you agree to first attempt to resolve any dispute by contacting us directly through the form at /get-matched. We will respond within 30 days. If we cannot resolve the dispute informally, either party may pursue available legal remedies.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.

Changes to terms

We may update these Terms from time to time. Material changes will be noted with an updated "Last updated" date at the top. Continued use of the Site after changes constitutes acceptance of the updated Terms.

Entire agreement
